1. Introduction

Yazmarket.com has made available on its website www.yazmarket.com, an online marketplace (hereinafter "yazmarket.com Marketplace") that allows individuals, over 18 years of age, upon registration on the website ( hereinafter "Customer"), the purchase, through yazmarket.com, of new Products from Sellers outside yazmarket.com, at prices and conditions established by the Sellers themselves.

"Products" means any physical good sold by Market Sellers.

"Sellers" means legal entities previously approved by yazmarket.com who put their Products for sale on the yazmarket.com Marketplace.

Yazmarket.com reserves the right to freely modify this information to adapt it to the applicable legislation, without the need for prior notice.

These Terms and Conditions are cumulative with the general conditions of use of the website www.yazmarket.com.

2.Purpose

This document establishes the conditions under which yazmarket.com makes available to the Client, within the scope of the yazmarket.com Marketplace, Products sold by other Sellers.

3- Operation of the yazmarket.com Marketplace

The yazmarket.com Marketplace allows the Customer to view and purchase Products marketed by Sellers on the yazmarket.com website.

The transactions carried out through the yazmarket.com Marketplace are held directly between the Client and the Sellers, in compliance with the precepts and other legal requirements in force at all times.

Yazmarket.com does not assume the position of an agent / distributor / representative of the Sellers, nor a reseller of the Products offered by the Sellers through the yazmarket.com Marketplace. The products advertised and sold on the yazmarket.com market are the sole responsibility of the market sellers, that is, with respect to their property, quality, safety, origin, guarantee and compliance with applicable legislation.

4- Client

The yazmarket.com Marketplace is intended exclusively for Private Customers. The Commercial Client will not be able to make purchases on the yazmarket.com Marketplace.

The Client will only be able to buy on the Marketplace after accepting the Terms and Conditions and the Privacy Policy without restrictions or reservations, as well as after creating a Private Client Account on the yazmarket.com website.

Acceptance is the digital acceptance of these Terms and Conditions when purchasing on the yazmarket.com website.

5- Products

All Products sold on the yazmarket.com Marketplace are brand new.

yazmarket.com assumes no responsibility for the information available in Marketplace Products.

6-Conditions of sale

The price and conditions of sale of the Marketplace Products are the sole responsibility of the respective Sellers.

The definition of the shipping methods, the respective costs and the geographic delivery areas are the sole responsibility of the respective Sellers.

The price is indicated in euros and already includes all applicable taxes and fees. Shipping costs are not included in the indicated price and can be consulted on the page of each product and when the Client proceeds to formalize the order.

7- Buy

The Marketplace purchase process is carried out autonomously by the Client at yazmarket.com.

When purchasing on the yazmarket.com website, the Customer must have a private Customer Account and digitally accept these Terms and Conditions.

After payment, the sellers must accept the orders and this acceptance (or rejection) generates an information email for the Customer. In case of refusal, the amount paid will be refunded.

The shipment and delivery of orders is the responsibility of the respective Sellers.

Yazmarket.com is not the Seller of Products purchased through the yazmarket.com Marketplace, and does not assume any responsibility derived from the transactions carried out between the Client and the Sellers, nor for the Products sold or the respective after-sales assistance.

8 - Signature of the sales contract between the client and the sellers

Yazmarket.com is not the Seller of the Products purchased through the yazmarket.com Marketplace, and the Sellers, best identified in each of the Products, are the party that contracts with the Customer for the purchase and sale of said Products.

The contracts for the purchase and sale of the Products, made available by the Sellers, are concluded between the Sellers and the Customer under the decisive condition that the Products are available.

The Sellers must confirm to the Client the acceptance of the orders within a maximum period of 72 (seventy-two) hours from the receipt of the order for the respective orders.

If the Sellers do not accept orders within a maximum period of 72 (seventy-two) hours, the contract of sale (between the Client and the Sellers) will be automatically terminated and the amounts paid by the Client will be refunded.

9- Billing

The issuance of the invoice is the sole responsibility of the Marketplace Sellers. The invoice will be issued by the latter, in compliance with the precepts and other tax requirements that are in force at all times.

10 - Shipping and delivery

Shipping and delivery of Marketplace orders is the sole responsibility of the respective Marketplace sellers.

Once the order is placed, the order data cannot be changed, that is, with regard to the shipping method, the delivery address and the receiving contacts.

Yazmarket.com does not intervene in the delivery processes, except for deliveries in Yazit where it functions only as a collection point, not assuming any responsibility for the status of the order.

11 - YAZ smart box

The Customer will have the option of YAZ Smart Box (that is, the delivery of the Products to a yazmarket.com store for subsequent collection by the Customer) only when the Sellers make this delivery method available. The Customer may choose the location and the delivery method in the payment process.

The yazmarket.com stores only serve as a collection point for Marketplace orders. Yazmarket.com does not make any validation or confirmation of the content and status of Marketplace orders, not being responsible for their status.

When the Client chooses the YAZ Smart Box delivery method, he agrees to pick up his orders at the store he selected, within the opening hours of the same, within a maximum period of 15 (fifteen) calendar days after being notified of these are available for survey. If the Client does not collect the orders within the aforementioned period, they will be sent for destruction, the Client losing the right to any return. Yazmarket.com does not return Marketplace orders to Sellers.

12 - Confirmation of receipt

It is the Customer's responsibility to confirm receipt of the Products and their conformity.

It is assumed that the products have been received within 21 (twenty-one) calendar days from the date of the respective shipment. This clause does not prejudice or condition the rights of the consumer provided by law.

13 - Non-conformities at the time of receipt

If the orders do not reach the Customer, arrive damaged or in disagreement with the information provided by the Sellers at the time of purchase, the Customer has the right to file a complaint with the respective Sellers. Yazmarket.com will only deal with non-conformities up to a period of 45 (forty-five) calendar days after the time of purchase. After this period, yazmarket.com will not intervene, and this situation must be managed by the Client directly and autonomously with the Sellers.

Products purchased within the scope of the yazmarket.com Marketplace cannot be returned to or exchanged for at yazmarket.com stores, nor are they covered by yazmarket.com's satisfaction / return policies.

The return of the Products is the responsibility of the Customer. Yazmarket.com does not intervene in the return process. The Customer must agree directly with the Sellers to return the Products.

The conditions for the return of Marketplace Products should be consulted on the page of the respective Product Sellers at yazmarket.com.

Disputes must be resolved directly between the Customer and the Sellers.

14 - Free right of withdrawal

Under the terms of current legislation, the Customer has, within 14 (fourteen) calendar days from the date of receipt of the Product (s) ordered, the right to freely terminate the contract with the Sellers.

The return of the Products is the responsibility of the Customer. Yazmarket.com does not intervene in the return process. The Customer must agree directly with the Sellers to return the Products.

It is up to the Customer to bear the cost of returning the merchandise, except when the Sellers expressly agree to bear that cost. If the Sellers do not offer to collect the products themselves, the Customer must, within 14 (fourteen) calendar days from the date on which he communicated his return decision, return the Products to the Sellers.

The refund of the amount paid for the returned Products is made by yazmarket.com to the Client within a maximum period of 14 (fourteen) calendar days from the date on which the Sellers confirm the receipt and conformity of the orders returned by the Client or that the Client presents to yazmarket. .com and / or Seller's return receipt.

In accordance with Law No. 47/2014, of 07/28, and unless the parties agree otherwise, the Client cannot return:

  • Products manufactured according to the Customer's specifications or clearly personalized;
  • Products that, by their nature, cannot be reshipped or that can quickly deteriorate or become obsolete;
  • Sealed products that cannot be returned, for reasons of health protection or hygiene when opened after delivery;
  • Goods that, after delivery and by nature, are inseparably mixed with other Products.

Other specific conditions may apply in accordance with each of the Sellers. The return conditions can be found on the page of each of the Sellers at yazmarket.com.

15 - Refunds

The refund of the amount paid for the returned Products is made by the Seller to the Customer.

The return of payments is made using the same payment method used in the purchase (in the case of payment by ATM reference, the Seller will contact the Customer to indicate the IBAN where he intends to receive the refund) and prior confirmation by the Sellers of receiving the returned Products in accordance with the return conditions.

In the case of the return of all the Products of an order, the total paid by the Customer (Products + shipping) will be returned. If an order is partially returned, the Customer will receive a partial refund corresponding to the price of the returned Product (s) + shipping cost prorated for the quantity of Products in the order.

Yazmarket.com only intervenes in the refund process up to 45 (forty-five) calendar days after the moment of purchase. At the end of this period, yazmarket.com discards any responsibility and / or intervention, and the Client must directly and autonomously manage any matter related to returns.

16 - After sales

After-sales of Marketplace Products are the sole responsibility of the respective Marketplace Sellers.

The Client must directly and autonomously manage any question related to the after-sale with the Marketplace Sellers. The Customer may contact Sellers through their Customer Area at yazmarket.com or through alternative contact channels of the Seller present on the respective Seller's page on the yazmarket.com website.

17 - Warranty

Warranty for Marketplace Products is the sole responsibility of the respective Marketplace Sellers.

The guarantees provided in Portuguese legislation apply to Products purchased on the yazmarket.com Marketplace, for each type of Products.

In the event that the product is returned by the Customer, the Customer must bear the shipping costs. If the product does not fit, the shipping costs will be reimbursed by the Seller. If the product is misused, the shipping costs will be borne exclusively by the Customer.

18 - Seller evaluation

Yazmarket.com makes available to the Client mechanisms to evaluate the performance of the Sellers after the confirmation of the receipt of orders by the latter.

The evaluation is made through the attribution of stars and the application of evaluation criteria by the Client, and yazmarket.com does not monitor these evaluations, however, it may decide to remove, without prior notice, any evaluation whose content is marked as defamatory. .

Seller ratings are visible to all website visitors and are identifiable by the name of the respective user who posted them.

19 - Contacts

Contacts must always take place directly between the Customer and the Sellers through the messaging tool available on the yazmarket.com website. The Client will be able to access the messaging tool through their Client Area, in the detail of the orders, option "Contact the Seller" or in the detail page of each offer, option "Ask the Seller".

The Client will be able to consult the response of the Sellers in their Client Area at yazmarket.com, in "My messages", and the Marketplace Sellers must respond to the Client's messages within 48 (forty-eight) hours.

Alternate seller contacts can be found on each seller page of the yazmarket.com website.

20 - Disputes

Yazmarket.com is not part of the sales contract concluded between the Sellers and the Customer. In this way, disputes must be resolved directly between the Client and the Sellers, and eventually yazmarket.com may be an intermediary through the messaging tool made available to them on the Marketplace. However, yazmarket.com will not assume any responsibility to the Customer, as it is a stranger to the contractual relationship between the Customer and the Seller.

Yazmarket.com will only handle litigation situations up to 45 (forty-five) calendar days after the time of purchase. At the end of this period, yazmarket.com will not intervene in the dispute, and this situation must be managed by the Client directly and autonomously with the Sellers.

21 - Personal data

In accordance with these Terms and Conditions, yazmarket.com makes available through its Marketplace, an online marketplace that allows Customers to buy, through yazmarket.com, new Products from Sellers, treating, in this context, data personal data of your Clients.

In order for the Client to be able to access and enjoy the Marketplace, they must log in in advance through the yazmarket.com online account.

Before completing the purchase, yazmarket.com wishes to provide you with important information about the processing of your personal data within the Marketplace.

21.1 - Why do we process your personal data?

Your personal data will only be processed within the Marketplace for the execution and management of the sale contract, including its payment, between the Client and the Sellers, as well as for the evaluation thereof by the Client.

21.2 - Who is your personal data provided to?

In the context of the Marketplace, your personal data is only provided to Sellers. Yazmarket.com also provides your personal data to subcontractors under IT service contracts.

21.3 - How long is your personal data kept?

Within the scope of the Marketplace, yazmarket.com will only retain your personal data for the average useful life of the Products sold on the Marketplace.

21.4 - Do you know what your rights are as the owner of Personal Data?

As the owner of personal data, you can exercise, at any time, the following rights: right of access to the data that concern you, right of rectification, right of limitation of treatment and right of portability, through the contacts indicated in point 2 of this clause.

In the Marketplace, the communication of the Customer's personal data is a necessary requirement to conclude the contract for the purchase and sale of the Products, therefore, if you do not wish to provide your data, the contract cannot be concluded.

22 - Responsibility

Yazmarket.com is not responsible for the defective use of the Marketplace by the Client or for any error on their part in the purchase process, nor for events attributable to a third party.

Yazmarket.com is not responsible for the content and information provided by Marketplace sellers. Said content and information are the sole responsibility of the Sellers. Yazmarket.com is not responsible for the sales made through the Marketplace, and any claim related to the purchase must be sent to the Sellers, who are responsible for assuming responsibility for the purchase and sale agreements between the Client and the Sellers, such as provided for in Clause 20.

The Customer is responsible for his use of the yazmarket.com Marketplace, that is, the information he provides when purchasing and the content of the Sellers' evaluation.

23 - Intellectual Property

All content and information on www.yazmarket.com and its subdomains are the property of yazmarket.com and therefore the use, reproduction, copying and dissemination by other means of logos, texts, images and videos on that website is subject to prior authorization to that effect.

Any Customer must comply with the contractual and legal conditions applicable to the Products sold on the website www.yazmarket.com, namely with regard to the use of intellectual rights, copyright and related rights, personal use rights that regulate copies, reproduction, rentals, etc. Yazmarket.com cannot be held responsible for any improper use that may be made of these Products.
